2. Terms and Conditions of Use and Contracting

Access and use of this website attribute the condition of User (whether B2B professional or B2C final consumer), who accepts the General Conditions reflected herein. The integrated WooCommerce platform allows for the direct acquisition of products, the contractual execution of which is governed by the following:

  • Pricing: Given the technical nature of the site, catalog prices may be displayed without taxes. For final consumers, VAT and flat-rate logistics fees (MRW) will be clearly broken down in the shopping cart before finalizing payment.

  • Payments and Shipping: Transactions are processed through Stripe (secure gateway). Logistics are handled via MRW; the carrier is responsible for compliance with delivery schedules once the material leaves our warehouse.

3. Intellectual and Industrial Property

SURGIWELL SL, by itself or as an assignee, is the owner of all intellectual and industrial property rights of its website, as well as the elements contained therein (engineering images, technical descriptions, videos, logos, color combinations, structure, and design). 4. Exclusion of Warranties and Liability

  • Professional Use: Ecowell instruments are intended exclusively for professional use by qualified personnel. SURGIWELL SL declines any responsibility for damages derived from improper use or use outside clinical protocols.

  • Warranty: In accordance with Spanish consumer regulations, a 3-year warranty against manufacturing defects is offered for final consumers. For the professional sector, the provisions of the Commercial Code shall apply.

  • Availability: SURGIWELL SL is not responsible for damages due to errors in content, lack of portal availability, or the transmission of viruses, despite having adopted all necessary technological measures to prevent it.

5. Modifications

SURGIWELL SL reserves the right to make the modifications it deems appropriate to its portal without prior notice, being able to change, delete, or add both the content and services (prices, stock, specifications) and the way in which they are presented or located.

6. Links

In the event that this website contains links to other Internet sites, SURGIWELL SL shall not exercise any type of control over said sites and content. In no case shall it assume any responsibility for the contents of any link belonging to a third-party website.

7. Applicable Legislation and Jurisdiction

  • Health Returns (Art. 103.e LGDCU): It is expressly stated that, for reasons of hygiene and health protection, the right of withdrawal is not permitted for instruments unsealed after delivery. Returns of items with personalized engraving will also not be accepted.

  • Jurisdiction: For the resolution of disputes, the parties submit to the Courts and Tribunals of the city of Terrassa (Barcelona). In the event that the User acts as a final consumer, the jurisdiction of the consumer’s domicile shall apply in accordance with the law.
